Hope so. Trump is the country's CEO. Can you imagine a judge preventing a new CEO from firing someone who is not "with the new program?" If Trump wanted to fire the guy there was probably a good reason, such as being incurably Woke.

"Pending before the justices was a technical question about whether a temporary order from a lower court that paused Dellinger’s dismissal for a few weeks should be blocked. But the court’s decision failed to resolve that question, essentially punting. If the lower court issues a preliminary injunction after that hearing, the Department of Justice could then appeal that ruling back up to the Supreme Court.

“The best explanation for why a majority of the justices opted to put off a ruling in this case for now is because of a concern that they’d otherwise open the floodgates to dozens of emergency requests when all that the lower courts had entered were time-limited temporary restraining orders,” said Steve Vladeck, CNN Supreme Court analyst and professor at Georgetown University Law Center.

“This way, the court avoids endorsing that procedural move, while preserving the ability to resolve whether Dellinger should or should not be allowed to stay in his job as soon as the middle of next week,” he said."

Correct... Trump case not dead. SCOTUS just wants it to go through normal appeal process... unfortunately.

"The court kept the order in place while at the same time staying the Trump administration’s application in place — essentially punting on the issue.

Justices Sonia Sotomayor and Ketanji Brown Jackson noted that they would have denied the government’s application outright, while Justices Samuel Alito and Neil Gorsuch said that they would have granted it."

So isn't it illegal to not hire the best qualified if is white male and a trans/LGBT or black is hired instead?

Doesnt discrimination work both ways?

As soon as Coney Barrett was appointed she metamorphosed into a far left Never Trumper like Roberts. The only one on the SCOTUS who is there on merit is Thomas. All the rest are DEI hires or some variation of DEI hire. Courts evolved from dunking alleged witches in water. If all except Thomas were replaced by AI it would improve the SCOTUS. Alternatively, they could be replaced by monkeys. Monkeys have been shown to outperform stockbrokers so I can't see why they wouldn't also outperform judges and lawyers

what about Alito?

Alito is good and Gorsuch about 75%. Neither a DEI hire. Stop fanning senseless emotionalism. The Supremes will address this whole issue, by picking the best case to do so. Read the Coffee and Covid substacks by Jeff Childers to understand things in this area.

The trans/lgbt could be qualified as well… Qualification, integrity and professionalism should not exclude either parties. ANW made a good point “ variation of DEI “. DEI, white, black, yellow, blue have their imbeciles…

Trump and his team need to study the Constitution, and then tell the judges to pound sand.

The Constitution clearly states that there are three EQUAL branches of government.

The ONLY responsibility of the Judicial Branch is to INTERPRET LAWS. The laws are clear.

The Executive Branch's responsibility is to ENFORCE those laws, which DOES give Trump's administration authority to hire and fire people within his own branch in order to enforce the laws of the land.

The Legislative Branch (Congress/Senate) job is to WRITE those laws, NONE of which can conflict with the Constitution, since the Constitution is the SUPREME LAW OF THE LAND, and MUST BE FOLLOWED.

So, if Trump's team know they are not breaking any laws that are in line with the Constitution, and if those laws have indeed been properly legislated through Congress, then they need to ignore the judiciary and do what the know the Constitution authorizes them to do.

However, Trump can't run on Executive Orders. Those are NOT laws. Those are only supposed to be used for emergency, and very TEMPORARY situations only, and should be very rarely used. So Trump needs to light a fire under Congress, and tell them to GET THEIR DAMN JOB DONE. Congress needs to LEGISLATE what Trump wants, or else it means NOTHING.

Explain to me again the three branches of government and the authority the chief executive (the president) has to run the executive branch, powers all vested in a president by the US Constitution. I must be missing something.

Suppose a whistle blower office (WBO) protected a whistle blower who spilled nasty stuff about a presidential candidate while he's in some other federal office. Now suppose this candidate became the POTUS. What is to stop him from stanching the outstanding cases and then firing everybody in the WBO? If WBO head knows he's going to be kicked out, will he ever do his job again? These things set precedent. So Trump's actions will cause huge problems in the future.

Regardless of the chair, to vote for outright corruption is a partner on crime to the defendant as the guilty are ushered to the door if they are indigent. If you have any money though, you will be drugvthrough a very archaic system and punished.if you have enough money, you get court supervision or probation, Charges reduced, fined.

The majority of the Supreme Court judges were appointed by Democrats from Obhama to Biden.

DEI is a form of insanity because it created incompetence and deliberate risk/ poor performance into the workplace and schools.

In fact DEI can kill an innocent person. Imagine a surgeon, fireman, pilot, who got his/her job because they were DEI as opposed to the best person for the job.

When SVOTUS defies common sense, and do it so obviously politically , the guilty judges need to be removed by force and be permanently disbarred and impeached. Preferably without pay and even pension.

Impeachment must not be limited and this is an example of deliberate "political defiance" by SCOTUS.

Impeach these bad judges.

If I were Trump, I would be furious by such obviously nefarious conduct in SCOTUS .

The biggest threat to MAGA are the courts and no one should assume that the Supreme Court will either take a case from the Trump administration or rule in favor. What's really needed is for the Congress to get it's act together. What's also required is for MAGA to get more people elected to the Congress (in particular) and the Senate.

The President and any employer has the right to fire anyone, maybe SCOTUS did not want to enter this fray, because there really is not any question that the President has that right!

Trump has to find some better reason to fire the head of the so-called "whistleblower" agency.

Perhaps evidence of fraud or malfeasance would do it, but I'm not a lawyer.

SCOTUS under Chief Justice Roberts just doesn't like to get involved in anything. Roberts and some of the others want to be "liked" by the D.C. establishment, they like the cocktail parties, they're not activists.

Some courts are breaking Trump's way, some not. I think that pattern will continue.
